1. Acceptance of Terms
By accessing or using Cornfield Voice’s Voice over Internet Protocol (VoIP) services (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Our VoIP service provides voice communication services over the internet, including but not limited to voice calls, voicemail, call forwarding, and related telecommunications features. The Service is intended for legitimate business and personal communications only.
3. Account Registration and Security
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use Policy
4.1 Permitted Uses
The Service may be used only for lawful purposes and in accordance with these Terms. You may use the Service for:
- Legitimate business communications
- Personal communications with friends, family, and associates
- Customer service and support calls to existing customers
- Appointment confirmations and service notifications to existing customers
4.2 Prohibited Uses
You are expressly prohibited from using the Service for:
Cold Calling and Telemarketing:
- Outbound cold calling to individuals or businesses without prior established relationships
- Unsolicited sales calls or marketing calls
- Any form of telemarketing activities
- Robocalls or pre-recorded message campaigns to unknown recipients
Call Center Operations:
- Operating or conducting business as a call center
- High-volume outbound calling operations
- Third-party calling services or call center services
- Bulk calling campaigns
Automated Dialing:
- Use of automated telephone dialing systems (auto-dialers)
- Predictive dialers or power dialers
- Any automated calling equipment or software
- Mass calling applications or services
Other Prohibited Activities:
- Harassment, threats, or abusive communications
- Fraudulent, deceptive, or misleading communications
- Spam voice messages or unsolicited communications
- Violation of any applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and state and federal do-not-call regulations
- International revenue sharing fraud (IRSF) or similar schemes
- Transmission of malicious code or attempts to breach security
- Interference with the Service or other users’ use of the Service
5. Compliance with Laws
You must comply with all applicable federal, state, and local laws and regulations, including but not limited to:
- Telephone Consumer Protection Act (TCPA)
- Telemarketing Sales Rule (TSR)
- CAN-SPAM Act
- TRACED Act
- State and federal do-not-call regulations
- Privacy laws and regulations
- International telecommunications laws (if applicable)
6. Service Availability and Performance
We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. Service may be subject to limitations, delays, and other problems inherent in internet communications. We are not liable for any failure or delay in service performance.
7. Emergency Services Limitations
Our VoIP service has limitations regarding emergency services (911). We’ll do our best. But if you’ve got lousy internet, you have given us the wrong address, or any number of other things, your call to 911 may not go through. You may die. We accept no liability for your inability to receive emergency services via our service. Please use your cell phone to call 911. But we do provide 911 and your call should go through if the stars align.
8. Privacy and Data Protection
We collect, use, and protect your information as described in our Privacy Policy, which is incorporated into these Terms by reference. You consent to our collection and use of technical data and related information to facilitate software updates and product support.
9. Payment Terms
Service fees are billed in advance on a monthly basis unless otherwise specified. You agree to pay all charges incurred under your account. We reserve the right to suspend or terminate service for non-payment after appropriate notice.
10. Suspension and Termination
We may suspend or terminate your account immediately without notice if:
- You violate these Terms, particularly the Acceptable Use Policy
- Your account is used for prohibited cold calling, call center operations, or automated dialing
- You fail to pay applicable fees
- We reasonably believe your use may harm our network or other users
- Required by law or regulatory authority
You may terminate your account at any time with appropriate notice as specified in your service agreement.
11. Monitoring and Enforcement
We reserve the right to monitor usage patterns and call volumes to ensure compliance with these Terms. Unusual calling patterns, high-volume outbound calling, or other indicators of prohibited use may result in immediate account review and potential termination.
12. Intellectual Property
The Service and all related technology, software, and materials are owned by us or our licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.
15. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Service, including your violation of these Terms or applicable laws.
16. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes through the Service or by email. Your continued use of the Service after such notice constitutes acceptance of the modified Terms.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of Illinois. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of American Arbitration Association.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and us regarding the Service.
